Somerset: Environment Agency withdrawal of main river maintenance

During August, several landowners in Somerset were informed by the Environment Agency (EA) of its decision to withdraw maintenance on certain Main Rivers in the county.

This change is understood to stem from significant funding constraints, with the EA receiving only 60% of the budget it requested from the Treasury. As a result, the Agency is now focusing its limited resources on areas deemed to present the most critical flood risks.

The EA does not hold a legal duty to carry out river maintenance. While it has historically exercised its powers to operate and maintain statutory Main Rivers, it has acted under permissive powers—undertaking maintenance only where it chooses, where affordable and where risk to people and property is highest.

Maintenance withdrawal marks a notable shift in flood risk management across Somerset. The decision was made without prior consultation and provides only six months’ notice of full withdrawal, leaving limited time for stakeholders to respond.

The CLA is deeply concerned about the potential increase in flood risk to rural communities, farmland, and environmentally designated sites. This change places unexpected responsibilities on land managers. The government has not confirmed what support, technical guidance, or financial assistance will be available.
