The rates set out in the Guidance Note, together with the energy Networks Association (ENA) Explanatory Notes, represent an increase in owner's payments and a rise in occupier's compensation and are recommended by the CLA/NFU and FUW after negotiation with the ENA. They are the best achievable in the circumstances and are in accordance with the principles of electricity wayleave payments. However, they are not obligatory and may be varied where appropriate by agreement with the ENA company.
