This handbook deals with a little-known, yet long-standing provision of law: the ability to prevent the creation of new public rights of way by lodging – with highway authorities – maps, statements and statutory declarations establishing the existence and status of public rights of way across land.

The lodging of such material serves to prevent the creation of new public rights of way through the process of "deemed dedication".

This provision can be of great assistance to all landowners and is also an important element if permissive access is to be granted.
