CLA: Still no guidance for farmers and land managers to help comply with changes to the Habitats Regulations "Even though the new controls designed to protect a number of rare species have already come into force, DEFRA and Natural England have still not produced the promised guidance telling farmers and land managers how to comply," said Ben Underwood, Conservation Adviser at the Country Land and Business Association (CLA).
"We have known these regulations were coming for over a year now, and DEFRA has always maintained that the best way for land mangers to avoid committing an offence is to comply with official guidance. The fact that it has still not been prepared is frustrating to say the least," concluded Ben Underwood. From the DEFRA website: Defra is working with the Statutory Conservation Agencies (Countryside Council for Wales, Natural England), Welsh Assembly Government and the Forestry Commission to produce guidance to help operators undertake a risk assessment of the presence of EPS and their breeding sites and resting places and to advise on how to avoid committing an offence. We hope that this advice will reduce the burden on operators and minimise the need for a licence. |

Solicitors Indemnity Fund . Solicitors in the CLA Legal Team are not covered by the Solicitors Indemnity Fund in relation to professional negligence in relation to any advice given by them.
