CLA calls for more clarity on tree liability issues

The CLA has welcomed the progress made at the Tree Management for Public Safety conference while stressing the need for greater clarity on liability.

The conference - held at The Royal Geographical Society - looked at tree liability issues and discussed how landowners should care for trees to make sure the public is safe.

 

CLA Deputy President William Worsley, who spoke at the conference, said: "This has started the process positively. The CLA believes that all stakeholders throughout the industry, from local government to landowners, should work together as we believe the best solution will not come from Government.

 

"Any approach made to the issue needs to recognise the enormous benefits that trees bring to society - benefits that are often not understood."

 

The CLA Deputy President added: "Landowners value their trees and the contribution they make to the landscape. However, they feel they are being driven into taking unnecessary and costly tree management decisions which are disproportionate to the risk of harm caused by trees. It is a question of actual risk versus perceived risk.

 

The rural economy experts support the production of a defensible national basic standard that would become the reference of choice in any future court cases.

 

This would be proportionate to the real risk, address the legal, civil and health and safety obligations of all land owners and managers and form the foundation upon which those with responsibilities could build.

 

The standard should allow landowners to discharge their legal, civil and health and safety responsibilities without an undue detrimental effect on the environment or unnecessary costs to themselves or their businesses.

Solicitors Indemnity Fund . Solicitors in the CLA Legal Team are not covered by the Solicitors Indemnity Fund in relation to professional negligence in relation to any advice given by them.
